Tenancy in Common

Tenancy in common is co-ownership in which each party holds a separate, undivided interest, and those interests can be unequal. There is no right of survivorship, so any owner can sell, transfer, or pass on their share independently.

The structure is common in CRE syndications and partnerships, where investors put in different amounts of capital. Every co-tenant can use the whole property regardless of the size of their stake, and when co-tenants fall out, a partition action can resolve it.
